Welcome to Tiger Automation Controls and Diagnostics ("Tiger Automation," "we," "our," or "us"). By accessing our website, requesting services, approving a proposal, or engaging our company for work, you agree to the following Terms of Service.
1. Services Provided
Tiger Automation Controls and Diagnostics provides industrial automation, engineering, and manufacturing support services, including but not limited to:
Industrial equipment troubleshooting and diagnostics.
Root cause analysis and corrective action recommendations.
PLC programming, modifications, and system integration.
Reverse-engineering and analysis of existing or undocumented control systems.
Legacy PLC and controls system support.
Mechanical modeling, design, and engineering.
Electrical controls hardware design and development.
Software development, HMI programming, and automation solutions.
Manufacturing equipment repair, optimization, and process improvements.
Services are provided based on the agreed scope of work outlined in a proposal, estimate, work order, or other written authorization.
2. Estimates and Authorization
All estimates and proposals are based on the information available at the time they are prepared. Actual project requirements may change as additional information becomes available or unforeseen conditions are discovered.
Customers must authorize work before services begin. Additional work outside the original scope may require a revised estimate or written approval. If changes are communicated the day of execution, emergency fees may apply.
Any changes, additions, or modifications requested on the day scheduled work is to be performed that differ from the approved quote or scope of work may result in additional labor charges, emergency or expedited service fees, material costs, and scheduling adjustments. Tiger Automation reserves the right to revise the original quote or issue a change order for customer approval before proceeding with the additional work.
For troubleshooting and reverse-engineering projects, the exact cause of a problem or the extent of required repairs may not be known until an initial investigation is completed.
3. Rates and Payment Terms
Service rates, minimum charges, travel expenses, and project pricing will be communicated before work begins.
Unless otherwise agreed in writing:
Invoices are due within 30 calendar days of the invoice date.
Parts, materials, software licenses, travel, and approved expenses may be billed separately.
Additional work outside the approved scope may result in additional charges.
Customers are responsible for payment for all authorized work performed, including diagnostic and investigative services.
*Please note that Tiger Automation Controls and Diagnostics must receive payment of the initial service invoice before returning to the site for additional service, unless otherwise agreed in writing.
Late payments may be subject to a 10% late fee compounded monthly.
4. Troubleshooting and Reverse-Engineering
Industrial troubleshooting and reverse-engineering may involve existing equipment, undocumented PLC programs, obsolete hardware, incomplete electrical drawings, and unknown operating conditions.
Tiger Automation will use reasonable professional efforts to identify the root cause of reported problems and recommend appropriate corrective actions.
However, customers acknowledge that:
Not all equipment faults can be identified immediately.
Existing equipment may contain pre-existing mechanical, electrical, software, or programming deficiencies.
Troubleshooting may reveal additional problems outside the original scope.
Reverse-engineering does not guarantee that all undocumented functions, interlocks, or original design intentions can be identified.
Repairs or modifications may require additional work, materials, or engineering.
We do not guarantee that every machine fault can be resolved or that existing equipment can be restored to its original operating condition.
5. Customer Responsibilities and Equipment Safety
Customers are responsible for providing safe access to equipment and ensuring that appropriate site safety procedures are followed.
Customers must disclose known equipment hazards, safety concerns, machine modifications, and relevant operating restrictions.
Customers are responsible for ensuring that machinery is properly isolated, locked out, and made safe when required.
Any recommendations involving machine safety, guarding, emergency stops, safety circuits, or control modifications must be reviewed and validated before equipment is returned to production.
Tiger Automation will not knowingly bypass safety devices or implement unauthorized safety modifications.
6. Software, Programming, and Data Backups
Customers are responsible for providing access to existing PLC programs, HMI applications, software, drawings, and other documentation necessary to perform authorized work.
Where practical, existing programs and configurations should be backed up before modifications are made.
Tiger Automation will exercise reasonable care when modifying existing control systems. However, no backup or restoration process can be guaranteed to succeed in every situation, particularly with obsolete, damaged, password-protected, or unsupported equipment.
Customers are encouraged to maintain independent backups of their original programs, configurations, and machine documentation.
7. Designs, Software, and Intellectual Property
Unless otherwise agreed in writing, customers retain ownership of their existing equipment, programs, drawings, and materials supplied to Tiger Automation.
Ownership and licensing of newly developed designs, software, PLC programs, and engineering deliverables will be determined by the applicable written proposal or service agreement.
Tiger Automation retains ownership of its pre-existing tools, methods, templates, reusable code libraries, technical knowledge, and proprietary processes.
Customers may not reproduce, distribute, or commercially reuse proprietary Tiger Automation materials without appropriate authorization.
8. Confidentiality
Tiger Automation recognizes that customers may share confidential business information, manufacturing processes, equipment designs, software, and proprietary technical documentation.
We will use reasonable care to protect customer information and will not knowingly disclose confidential information to unauthorized third parties, except when required by law or necessary to perform authorized services.
Customers may request a separate nondisclosure agreement when appropriate.
9. Equipment Downtime and Limitation of Liability
Industrial manufacturing equipment and automation systems involve inherent operational risks.
Tiger Automation will perform services with reasonable professional care. However, we are not responsible for pre-existing equipment conditions, undisclosed defects, failures caused by third-party modifications, or equipment failures unrelated to our work.
To the fullest extent permitted by applicable law, Tiger Automation shall not be liable for indirect, incidental, special, consequential, or punitive damages, including lost production, lost profits, business interruption, or loss of revenue.
To the fullest extent permitted by applicable law, our total liability arising from a particular service engagement shall not exceed the amount paid to Tiger Automation for the specific services giving rise to the claim.
Nothing in these terms excludes liability that cannot legally be excluded under applicable law.
10. Third-Party Equipment and Software
Tiger Automation may work with equipment, components, software, and control systems manufactured or supplied by third parties.
We are not responsible for manufacturer defects, discontinued product support, software licensing restrictions, or third-party equipment failures outside our control.
Customers are responsible for maintaining appropriate software licenses and ensuring that they have authorization to access and modify equipment and programs.
11. Scheduling and Cancellation
Scheduled services and project timelines are subject to availability, equipment access, material availability, and customer cooperation.
Customers should provide reasonable notice when canceling or rescheduling services.
Work already performed, approved expenses, materials purchased, and applicable cancellation charges remain the customer's responsibility.
12. Warranty and Service Limitations
Tiger Automation will perform services in a professional and workmanlike manner.
Unless otherwise specified in a written agreement, no guarantee is made that troubleshooting, programming, or engineering services will eliminate every existing or future equipment problem.
Third-party equipment, components, and software remain subject to their respective manufacturers' warranties.
Any additional warranty or performance guarantee must be expressly documented in writing.
13. Governing Law
These Terms of Service shall be governed by and interpreted in accordance with the laws of the State of Texas, without regard to conflict-of-law principles.
Any legal proceedings arising from these terms shall be brought in a court of competent jurisdiction in Texas, unless otherwise required by applicable law.
14. Changes to These Terms
Tiger Automation Controls and Diagnostics reserves the right to update these Terms of Service as business practices, services, or applicable laws change.
Updated terms will be posted on our website with a revised effective date.
